Conspiracy defendant is no show, woman takes plea deal

Adam H. Kjergaard, 38, of Irene, S.D., failed to appear for a pretrial hearing in the Knox County District Court on May 1.

Kjergaard is charged with forgery and conspiracy to commit a felony for allegedly writing a number of checks on the account of a deceased man.

Knox County Public Defender Rodney Smith of O’Neill, on behalf of the defendant, moved for continuance. The prosecutor objected and the Honorable Mark Johnson denied the motion. The judge ordered a bench warrant be issued and revoked Kjergaard’s bond, $5,000, 10% cash, filed Feb. 6.

Kjergaard had signed a waiver of extradition Feb. 7, an agreement not to contest extradition to Nebraska, to comply with amendment to bond conditions that allowed him to reside in South Dakota.

He entered pleas of not guilty Jan. 29  to the Class 4 felonies.

The complaint filed by John Thomas, Knox County prosecutor, alleges Kjergaard passed 20 checks at Knox County businesses between Oct. 5 and Oct. 12, totaling $2,721.92, drawn on the account of the late Allen O’Donnell.

The complaint also alleged the defendant, on Oct. 5, conspired with a second defendant, Sara Thorburn, 23, also of Irene, to commit forgery.

Thorburn, who is represented by court-appointed attorney, Martin Klein of Neligh, pleaded guilty to amended information last Wednesday, after reaching a plea agreement with Thomas. Per terms of the agreement, Thorburn was re-arraigned on a Class 1 misdemeanor count of attempted conspiracy. Thorburn and Thomas agreed to a recommendation of a one-year probation sentence and Thomas agreed to file no additional charges in the case.

Thorburn waived her right to a preliminary hearing and entered the guilty plea. The parties also agreed to waive a presentence investigation. A restitution hearing and sentencing are set for May 28 in the district courtroom.
